What is Extended Right of Use?

An Extended Right of Use is a licensing framework that allows you to use eligible PromoCell products in defined commercial activities beyond standard research use. These rights adhere to industry-standard licensing practices and are designed to provide a clear understanding of your options within the scope of our licensing.

With this trustworthy foundation you can use our products optimally within your commercial applications.

Important: These products are intended for in vitro use only and not for diagnostic or therapeutic procedures.

Why is Extended Right of Use required for commercial cell culture applications?

Biological materials such as primary human cells and specialized cell culture media are generally supplied for research use only (RUO). This means that they can be used for basic research, exploratory studies, and internal scientific investigation, but not for activities connected to commercial products or services.

However, many organizations, such as biotechnology companies, diagnostic developers, and contract research organizations (CROs), rely on primary cells and media for development, validation, and production of commercial applications.

What does Extended Right of Use cover?

With an Extended Right of Use, you may use eligible PromoCell products in commercial, non-diagnostic and non-therapeutic in vitro applications, including:

  • Cell line generation: Generate and validate cell lines for commercial research or development activities.
  • Assay validation: Validate assays for commercial workflows (e.g., biotechnology applications).
  • Quality control (QC), validation, and testing: Use of products in QC/testing workflows that support commercial production or development.
  • Service offerings / contract research: Provide research or testing services to third parties (e.g., CROs or specialized testing laboratories).
  • Production and process development workflows: Use of products within production-related workflows and process development for cell-based technologies.

These are example applications and not an exhaustive list.

Important: Extended Right of Use does not apply for products manufactured under EXCiPACT™ GMP standards.

No. An Extended Right of Use must be acquired at the time of purchase of the cells or media. It cannot be applied retroactively to products that have already been ordered or are in use.
Organizations providing research or testing services to third parties, such as CROs, may require Extended Right of Use when our PromoCell products are used as part of commercial service offerings. The appropriate Extended Right of Use depends on how the cells or media are integrated into the service workflow.
Yes. Our PromoCell primary cells can be used in assay development or validation workflows when the appropriate Extended Right of Use is obtained. The exact permissions depend on the intended commercial application.
